 TERMS AND CONDITIONS OF BUSINESS 2021

Soteria Salus (Pty) Ltd services, including (without limitation) our website and other interactive properties through which the services are delivered (collectively, the “Service”) are owned, operated and distributed by Soteria Salus (referred to in our Privacy Notice as “Soteria Salus ” or “we” and through similar words such as “us,” “our,” etc.).

The Privacy Notice outlines the personal information that Soteria Salus may collect, how Soteria Salus uses and safeguards that information, and with whom we may share it. It is available on request.

 Soteria Salus encourages our customers, visitors, business associates, and other interested parties to read our Privacy Notice, which applies to all users.

 By using our Service or submitting personal information to Soteria Salus by any other means, you acknowledge that you understand and agree to be bound by the Privacy Notice, and agree that Soteria Salus may collect, process, transfer, use, and disclose your personal information as described in this Notice.

 Further, by accessing any part of the Service, you are agreeing to THE TERMS AND CONDITIONS OF BUSINESS (the “Terms of Service”).

 IF YOU DO NOT AGREE WITH ANY PART OF THIS PRIVACY NOTICE OR OUR TERMS OF SERVICE, PLEASE DO NOT USE ANY OF THE SERVICES.

 

 GENERAL INFORMATION

 

All consultations are performed with the Client under the terms and conditions published on this website and furthermore are reviewed and communicated annually to all Clients as per below guidelines.

  

Our fees are payable within 7 days of presentation of invoice.

*         Excludes travel over 50km per day at approved AA Rate per km

*         Excludes accommodation expenses if applicable / where required to travel out of Johannesburg for the Client for work

*         50% deposit required up front

*         50% deposit required on handover of invoice / completion

 

Interest at 9% (nine percent) per annum can / will be charged for accounts that are unpaid after 30 calendar days from the date of the invoice being sent to the Client i.e. from date of invoice.

 

All consultations are performed with the client under the conditions outlined above and email confirmation of work being performed will be taken as acceptance of our “Terms of Service” accordingly.

 

Soteria Salus makes all reasonable endeavours to safeguard the confidentiality of clients and their intellectual property and personal information. Audits and Inspections are performed on the specified premise and therefore only highlight the deviations that are observed on that premise. This neglects the fact that same or similar or other deviations would be found at other premises that the company operates. Thus the Corrective Actions would need to be implemented where applicable or lacking on the other premises.

 

Findings and deviations issued on reports are based on the OHSA (Occupational Health and Safety Act and Regulations), the CR (Construction Regulations) and the DMA (Disaster management Act) requirements which are based on a SHEQ management system according to Soteria Salus representatives working knowledge of Management Systems implemented worldwide. This does not guarantee that all deviations to other South African / International standards and legislation have been identified (i.e. POPI Act, COID Act, BCE Act, NBR Act, NEMA Act, etc.) and Soteria Salus representatives accept no liability in this regard. The deviations and findings are specific to your company and can not be used for other companies to implement elsewhere.

 

The reports are compiled based upon information collected by Soteria Salus. Although every effort has been made to ensure the accuracy of data reported, Soteria Salus accepts no liability for any damage suffered by any person including patrimonial damages, consequential loss or any other damage of any nature arising out of any information contained in the reports.

 

 FEE STRUCTURE 2021

 

AUDITING SERVICES
Construction Site Compliance Audits

(R 2 000 weekly or R 2 500 bi weekly)

–       Performed on the specified premise for scope of works

–       Includes a hard copy of the Audit Findings Report to be kept on file

–       Includes a Monthly Findings Report to the Client CHSO / PM

–       Electronic pdf copy sent via email

 

Gap Analysis Audits
(R 4 000 – R 9 000 per site – company size dependent)

–       Performed on the specified premise to highlight deviations for compliance

–       Includes a signed hard copy of the Audit Findings Report to be kept on file

–       Electronic pdf copy sent via email

 

OCCUPATIONA HEALTH AND SAFETY FILE SERVICES
Initial Safety File Compilation
(R 4 000 to R 10 000 – risk category dependant)

–       Created for the specified project / premise

–       Includes a hard copy for site (soft copy of the file available on Dropbox on request)

–       Reprint copies for the same site will be charged for @ R 1 750

–       Initial File Training and signatures will be done for free

 

Secondary files
(R 2 500 to R 4 500 dependant on risk category)

–     Created for the specified project / premise

–     Includes a hard copy for site (soft copy of the file available on Request)

–     Realignment will be charged for @ R 1 000

–     Reprint copies for the same site will be charged for @ R 1 750

–     File Training and signatures will be charged for @ R 1 750

 

Vehicle Mobile files
(R 2 000 to R 4 000 dependant on risk category)

–     Created for the specified vehicle

–     Includes a hard copy for vehicle (soft copy of the file available on Request

–     Realignment will be charged for @ R 750

–     Reprint copies for the same vehicle will be charged for @ R 1 250

–     File Training and signatures will be charged for @ R 1 750

 

IMPLEMENTATION SEVICES
Daily Rate :

–     R 3 500 – based on an 8 hour day (includes first 50km travelled)

–     Hourly rate of R 1 000 per hour will be applied after 8 hours.

(Monthly Inspections /  Auditing )

 

Hourly Rate :

–     R 1 250 for the first hour for site work (includes first 50km travelled)

–     R 1 000 per hour there after.

(Risk Assessments / Investigations / DOL Queries / Training)

 

FOOD PREMISE AND BUSINESS SERVICES
COA (Certificate of Acceptability)
(R 4 250 per site)

–     COA Obtained with relevant Inspector for the specified premise

–     Includes a hard copy of the certificate for site
–     Extra premises will be charged for @ R 3 500 each

 

Fire Plan Approval
50% deposit required up front

–     R 3 250 per site

–     Extra floors will be charged for @ R 1 750 each

–     Excludes Fire Approval costs at Fire Department of approximately R 450 per floor

  

Business License
50% deposit required up front

–     R 3 750 per site

–     Extra businesses will be charged for @ R 3 000 each

–     Excludes Business License costs at Municipality (Region Tariff Dependant)

 

NOTICE PERIOD / LEGAL :

 In order to cancel the contract at least a full calendar months notice will be given to Soteria Salus, in order for Soteria Salus or its representatives to completly hand over all the work to the newly appointed and designated Safety Officer for the Company.

 

Soteria Salus will not be liable for any legal charges incurred or for the recovery of any fees, should the client be involved in such costs.
